About these terms
These Terms of Sale apply to the purchase of native plants supplied by Mo Endemik. By purchasing plants from us, you acknowledge and agree to these terms.
Plant availability
Native plants are offered for sale only when they are available. Availability may vary according to propagation, growth, season, stock levels and the condition of individual plants. The availability of a particular plant is therefore not guaranteed until the purchase has been confirmed by Mo Endemik.
Prices and payment
Prices applicable to native plants are those communicated by Mo Endemik at the time of purchase. Full payment must be received before the purchased plants can be collected.
Collection
Plants are available for collection by the customer from the designated Mo Endemik nursery or collection location. Collection will only take place once full payment has been received and the purchase has been confirmed.
Collection timeframe
Customers must collect their plants within the timeframe communicated by Mo Endemik at the time of purchase. Customers should contact us as soon as possible if they are unable to collect within the agreed timeframe.
Living plants and natural variation
Plants are living organisms and may naturally vary in size, shape, colour, appearance and condition. Minor variations are an inherent characteristic of living plants and do not necessarily indicate a defect. Customers are encouraged to inspect plants before collection and to raise any concerns with us before taking them away.
No returns or exchanges
Due to the living and perishable nature of plants, Mo Endemik does not accept returns or exchanges after a plant has been collected by the customer. Customers should carefully consider their purchase and inspect the plant at the time of collection before taking it away. This policy does not exclude or limit any rights or remedies that may apply under applicable consumer protection law.
Care after collection
Once a plant has been collected, the customer is responsible for its transport, handling, planting and ongoing care. Mo Endemik cannot be responsible for deterioration, damage or loss resulting from unsuitable transport, handling, planting conditions, watering, environmental conditions, pests, disease or other circumstances occurring after collection.
Cancellations and refunds
Any request to cancel a purchase before collection should be made as soon as possible. Where a refund is applicable, it will be handled in accordance with these Terms of Sale and applicable law. No refund or exchange is provided simply because a customer changes their mind after collecting a plant, subject to any rights that cannot lawfully be excluded.
